Terms of Service

These Terms of Service govern your use of the services provided by Sawah Cyber Security. By engaging our services, you agree to these terms.

1. Definitions

In these Terms of Service, the following definitions apply:

  • "Company" refers to Sawah Cyber Security, with registered offices in Bali, Indonesia.
  • "Client" refers to any individual, company, or organization that engages our services.
  • "Services" refers to all cyber security services provided by the Company, including but not limited to penetration testing, vulnerability assessments, security consulting, managed security services, and training.
  • "Agreement" refers to the signed Statement of Work (SoW) or service agreement between the Company and the Client.

2. Scope of Services

The specific scope, deliverables, timeline, and pricing of each engagement are defined in a separate Statement of Work (SoW) or service agreement signed by both parties.

Any changes to the agreed scope must be documented in writing and approved by both parties before work begins on the modified scope.

3. Engagement Process

Each engagement follows a structured process. The Statement of Work will include:

  • Detailed scope and objectives of the engagement
  • Agreed timeline and milestones
  • Expected deliverables and reporting format
  • Pricing and payment terms

4. Confidentiality

Both parties agree to treat all information exchanged during the engagement as strictly confidential. This includes but is not limited to: technical findings, vulnerabilities discovered, security architecture details, and business information.

The Company will not disclose any findings or client information to third parties without explicit written consent from the Client, unless required by law.

5. Authorization & Legal Compliance

For services involving active security testing (penetration testing, red teaming, vulnerability assessments), the Client must provide explicit written authorization before any testing begins.

The Client warrants that they have the legal authority to authorize security testing on the systems and networks specified in the Statement of Work.

6. Limitation of Liability

While the Company takes every reasonable precaution to prevent disruption during security testing, the Client acknowledges that active security testing carries inherent risks. The Company shall not be held liable for any indirect, incidental, or consequential damages arising from the authorized testing activities.

The Company's total liability under any engagement shall not exceed the total fees paid by the Client for that specific engagement.

7. Intellectual Property

All reports, documentation, and deliverables produced during an engagement are the intellectual property of the Company. Upon full payment, the Client receives a non-exclusive license to use these deliverables for their internal security purposes.

The Company retains the right to use anonymized and aggregated data from engagements for research, benchmarking, and improving its services.

8. Payment Terms

Payment terms are specified in the Statement of Work. Unless otherwise agreed, invoices are due within 30 days of issuance.

Late payments may be subject to a 1.5% monthly interest charge. The Company reserves the right to suspend services in case of outstanding payments exceeding 60 days.

9. Termination

Either party may terminate an engagement with 30 days written notice. In case of termination, the Client shall pay for all work completed up to the termination date.

The Company reserves the right to terminate an engagement immediately if the Client requests activities that are illegal or outside the agreed scope of work.

10. Governing Law

These Terms of Service are governed by the laws of the Republic of Indonesia. Any disputes arising from these terms shall be resolved through arbitration in Denpasar, Bali.

11. Changes to Terms

The Company reserves the right to update these Terms of Service. Clients will be notified of material changes. Continued use of our services after notification constitutes acceptance of the updated terms.
